In a move that highlights the misguided fervor of certain leftist activists, Kimberly Bernard, a 35-year-old mother from Manhattan, is suing the city for at least $2.5 million, NY Post reported.
The lawsuit stems from her arrest during a protest over the release of Daniel Penny, a man who arguably acted heroically when he intervened during a dangerous situation on a New York City subway.
Bernard claims that the NYPD and Mayor Eric Adams falsely accused her of terrorism, turning her into a symbol of the radical left’s distorted priorities
Penny, who stepped in to subdue Jordan Neely—a mentally ill and potentially violent homeless man—has been at the center of a controversial case. Neely, known for his erratic and threatening behavior, was a clear danger to the innocent people around him.
Daniel Penny will stand trial starting Oct. 8, for the death of Neely.
Yet, instead of recognizing Penny’s actions as potentially lifesaving, Bernard and others like her protested his release, fixating on a man who stepped up when others might have been too afraid to act.
The NY Post reports that Bernard’s lawsuit accuses city officials of perpetuating a “bogus” terrorism charge against her through public statements and social media posts. She was arrested in May 2023 while protesting Penny’s release, and she alleges that police wrongfully linked her to a Molotov cocktail supposedly brought to the protest. Bernard insists she knew nothing about the explosive device and was never charged over it.
Regardless, of the far left, anti-vigilante Bernard’s cause, (which was basically locking up a hero), this is a serious lawsuit as nobody (not even woke radicals) deserve trumped up false charges.
Clearly Bernard was fixated that Penny is white and the dangerous, homeless, Neeley was black. One can be certain, if Penny was Black, not a soul would have protested to arrest the vigilante.
In fact, several cases of black males acting in similar fashion as Penny, (self-defense, restraining of violent perpetrators), received no media attention or far left scrutiny.
A grand jury declined to indict Jordan Williams on manslaughter and weapons charged stemming from the June 13 killing on a Brooklyn J train, in 2023. The 20-year-old had been arrested for the stabbing death of 36-year-old Devictor Quedraogo. The Queens man who argued he stabbed a subway rider to death in self-defense will avoid prosecution, city officials announced Wednesday.
Williams is black, killed another person of color on the train (rightfully in self-defense) yet nobody demanded Williams be locked away like a cold-blooded killer. One can obviously conclude Penny has been castigated and demonized by left wing lunatics such as Bernard because of his white skin.
When a detective informed Bernard of the pending terrorism charge while she was in custody, she claimed she was “absolutely terrified.” She said, “I thought I was going away for a very long time for such a serious charge. It’s a scary thought.” However, prosecutors dropped the terrorism charge within hours, opting instead for minor infractions that were eventually dismissed a month later.
While Bernard’s fear during her arrest may be genuine, it’s hard to ignore the irony of her protest. In standing against Penny, Bernard appears to have chosen the wrong cause. Penny’s intervention during the subway incident likely prevented further harm to passengers.
