Lawyers representing President-elect Donald Trump have formally requested New York Attorney General Letitia James to drop her civil fraud case against him, his family, and his businesses. Citing the need for unity and an end to partisan conflicts, Trump attorney D. John Sauer outlined the appeal in a letter exclusively obtained by The New York Post. The case, which has drawn national attention, revolves around a $454 million civil fraud judgment against Trump, a ruling he is actively appealing.
Sauer’s letter, as reported by The New York Post, underscores the significance of Trump’s “historic election victory” and frames the case as emblematic of the partisan divisions that have plagued the nation. “President Trump has called for our Nation’s partisan strife to end, and for the contending factions to join forces for the greater good of the country,” Sauer wrote. He added that the ongoing legal proceedings against Trump and his family were central to the recent election cycle’s political discord, urging James to dismiss the case “for the health of our Republic.”
The letter comes amidst a series of legal successes for Trump, a fact highlighted by The New York Post. Judges on a New York appeals court have shown openness to reversing the judgment, giving Trump’s legal team a boost in their quest for a favorable outcome. Sauer further emphasized the opportunity for Attorney General James to play a role in de-escalating the tensions surrounding Trump’s legal challenges. “You now have the singular opportunity to help cure this division,” he wrote.
The New York Post noted Sauer’s unique position as both Trump’s counsel in this case and his nominee for Solicitor General in the incoming administration. Drawing on his experiences, Sauer described the legal battles as “a flashpoint of national partisan division,” arguing that resolving these disputes would serve the greater good. “As counsel for President Trump in this appeal—and now as his nominee for Solicitor General of the United States—I strongly believe that it is necessary for the health of our Republic for the strife and lawfare to end,” he stated.
Sauer’s arguments, reported in The New York Post, also cited recent developments in other high-profile cases involving Trump. Special Counsel Jack Smith’s case against Trump related to the 2020 election was dismissed, and his appeal in the classified records case was dropped after a federal judge ruled that Smith’s appointment was unlawful. Similarly, in a separate New York case, Judge Juan Merchan granted Trump’s request to file a motion to dismiss charges brought by Manhattan District Attorney Alvin Bragg and removed the sentencing date from the schedule. “This case warrants the same treatment,” Sauer asserted.
Sauer also raised procedural issues in James’ case, particularly the statute of limitations, which he argued “bars claims and liability.” As reported by The New York Post, this legal hurdle could further undermine the attorney general’s case against Trump. Sauer urged James to recognize the broader implications of her decisions, stressing that dismissing the case could help bridge the nation’s partisan divide.
This letter represents the latest chapter in the ongoing legal battles between Trump and his opponents, as documented by The New York Post. The stakes remain high, with Trump’s team framing the issue as not merely a legal matter but a test of national unity and institutional integrity. Whether Letitia James will heed the call for dismissal remains to be seen, but the appeal underscores the complex interplay of law and politics in the Trump era.
