Federal Judges in NY, TX Block Trump Administration’s Use of Alien Enemies Act to Deport Suspected Gang Members

(TJV NEWS) Federal judges in New York and Texas have temporarily blocked the Trump administration from using the 1798 Alien Enemies Act to deport suspected illegal alien gang members. This move follows a decision by the U.S. Supreme Court, which lifted a previous block from U.S. District Judge James Boasberg, allowing the administration to invoke wartime authority to remove illegal migrants suspected of being affiliated with gangs like Tren de Aragua (TdA) or MS-13, Breitbart reported.

The legal challenges involved two cases. One was filed in Manhattan by attorneys representing two Venezuelan men detained in Orange County, New York, while another case, brought in Texas, also involved these same Venezuelans, who were contesting their potential deportation in Washington, D.C., as reported by CBS News.

In the New York case, U.S. District Judge Alvin Hellerstein granted temporary relief, blocking the deportation and movement of the detainees outside of the state or country. Meanwhile, in Texas, Southern District Judge Fernando Rodriguez Jr., appointed by President Trump, issued a ruling preventing the removal or transfer of the detainees from the El Valle Detention Center, as well as any other Venezuelans in Texas subject to deportation.

The case in Manhattan saw attorneys successfully argue for the block of deportation, with Judge Hellerstein, a Clinton appointee, granting the temporary injunction. In Texas, Judge Rodriguez cited the Supreme Court’s ruling that individuals detained under the Alien Enemies Act must receive adequate notice of their removal in a manner that allows them to seek habeas relief before deportation.

Rodriguez’s ruling emphasized that deporting the detainees would cause irreparable harm, as they could be prevented from seeking legal recourse. Additionally, he raised concerns that an erroneous removal could complicate the possibility of returning the individual to the U.S.

As previously reported by Breitbart’s Sean Moran, immigration activists had filed a lawsuit to block the Trump administration from using the Alien Enemies Act to expedite the removal of Venezuelan migrants suspected of gang affiliation. The Trump administration invoked the Act in March to facilitate the deportation of illegal Venezuelan migrants with ties to gangs such as TdA or MS-13, Breitbart reported.
